James McCallister, Senior and James McCallister, Junior - J04 and J43 CMA Lines

Generation One

James McCallister, Senior - born about 1725 and died 1801 in Bath Co, Virginia

James was probably born in Ireland.  We know that his wife's name was Mary, but beyond that nothing else is known for certain.  Some researchers have said that Mary's last name was McGloughin based on a marriage record from Pennsylvania.  Perhaps it is.  James and Mary were in Augusta County, Virginia (later Bath County), as early as 1764 when James purchased 150 acres of land on the Jackson River.  He was then granted, in 1766,  another 100 acres in Augusta County near the James River.

His will was probated in Bath County, Virginia in September of 1801 from which we discover the names of his children:

In the name of God Amen, I James McCallister, of the County of Bath and State of Virginia of sound mind and judgement but knowing that it is appointed for all men once to die, do make and ordain this my last will and testament in manner and form following: I recommend my soul to the divine being and disposed of all things and my body to be buried in decent and Christian like manner at the discretion of my executors hereafter mentioned and touching such worldly estate as it has pleased God to bless me with, after funeral expenses are paid, I dispose of in the following manner, to wit:

I give and bequeath to my beloved wife, Mary McCallister, fifty pounds in cash to be first paid out of my estate, and her bed and sufficient clothing, with the pewter, her trunk and wearing apparel and a horse creature of the value of twenty pounds and a cow. ITEM, I give and bequeth to my two daughters, Hannah Barnett and Mary Waters, twenty pounds in cash each, ITEM, I give and bequeath to my different grandsons, William McAllister , son to Thomas McAllister and James McAllister, son to John McAllister; James McAllister, son to James McAllister; James McAllister, son to Richard McAllister and James McCallister, son to Edward McCallister; James McCallister, son to Garrett McAllister, and James Barnett, each to have five pounds cash out of my estate. ITEM, I give and bequeath to my seven children, Thomas McAllister, John McAllister, Richard McAllister, Edward McCallister, Garrett McCallister, Hana Barnett and Mary Waters the residue of my estate, both real and personal, to be equally divided between them, except five shillings I give to my son James McCallister, all which legacies I do bind to the different legatees, their heirs and assigns forever. Lastly, I constitute and appoint my two sons, Thomas McAllister and John McAllister, executors of this my last will and testament, ratifying and confirming this to be my last will and testament. In witness whereof, I have set my hand and seal this fourteenth day of June, 1799.

Generation Two

James McCallister, Junior (James, Sr.) - was born about 1751 and died after 1820 in Cabell Co, Virginia

Traditionally known as the J43 line of the Clan McAlister Association (CMA) - Recent DNA evidence has proven that the J43 and J04 (James McAllister, Sr) lines are a match. This corroborates current theories based on research that the James McAllister, Jr. (J43) is the son of James, Sr. (J04).

Note - The reason that James, Jr. (J43) was not formerly connected to James Sr. (J04) is that previous research incorrectly place the date of James Jr.'s death much earlier and in North Carolina. There was a James McAllister who died in NC - there were brothers, James and John McAllister, who were partners in a business in Winchester, Frederick Co., Virginia, in 1789. That James moved to North Carolina and died intestate and indebted to brother John. (Chalkley. Vol. II. p. 59.) However, these two McAllisters were children of James and Mary McAllister, Sr. of Frederick, Co, VA. John McAllister, businessman of Winchester, Frederick Co., Virginia, left a will in Montgomery County, Tennessee, in 1828, which names brothers and clearly links him and his brother James to this other McAllister family.

So, why is James basically "cut out" of his father's will? The following is the theory of Janice McAlpin, a fellow McCallister researcher and retired law professor.

"First, James, Jr., was alive when the will was written in June 1799. Otherwise, the 5 shillings would have been left to the "heirs of my deceased son James." The 5 shillings was the entire legacy left to James. He did not share in the rest of the estate. His son James III received a separate bequest of 5 pounds, but the rest of James Jr.'s family was stuck with the 5 shillings.

"James received the token 5 shilling bequest as a formality to prevent him or his heirs from trying to claim a larger share of the estate. There are a couple of explanations for this. It could indicate that James had already received property from his father (possible, especially if he was the eldest son). It could also mean that James Jr. had displeased his father and he and his family were essentially being disinherited. It could also mean that James Jr. was well off and his siblings needed the extra money. Your guess is as good as mine on this point.

"There is no way to know from the wording of the will where James Jr. fell in the birth order because he was not listed with the 7 children who shared the bulk of the estate. I suspect those 7 actually were listed in birth order (common practice), with Thomas being the oldest of the 7 and Mary the youngest".

James, Jr. was in Botetourt Co, VA and Bath Co, VA tax lists from 1787-1811.  He was living in Kanawha Co, VA about 1817 when he was given a life estate as part of a land transaction between two of his son, John and James.  James Jr's son John sold part of his Kanawha land to his brother James III. James III was listed as "James Jr" in the deed. The deed specifically reserved a life estate for James McCallister Sr in the part of the land where he was then living. This transaction certainly implies that John and James Jr (James III) were brothers and that James Sr (James Jr) was their father.

Wood....granted to James McCallister with the exception that part of the said track of land that James McCallister Sr. now lives which part he is to enjoy in his natural life and at his dec. to James McCallister Jr."

Richard McCallister (James, Jr., James, Sr.) - was born 1802 and died on June 5, 1859 in Kanawha County, VA

Richard married Sarah Nicholas, January 11, 1821 in Kanawha County, VA - she was the daughter of John Nicholas and Margaret Swope.  Richard is also referred to as Richard McCallister of Turkey Creek.  He was issued on October, 16 1837 in Cabell County 270 acres on Turkey Creek.

  • He married Mary E. Harvey, 8 March 1845 in Cabell County, VA - she was the daughter of John and Jane Harvey
  • He married Vernela Evaline Cremeans, 4 July 1858 in Cabell County, VA

  • He married Martha Jane Dalton after 1899
